WhoseDev Terms of Service

Effective Date: June 9, 2025

1. Introduction

This Terms of Service Agreement (Agreement) is entered into by and between you (User) and AnotiAI, the operator of WhoseDev (we, our, or us). By accessing or using any part of the WhoseDev platform, including its desktop software, APIs, extensions, or web mirror, you agree to be bound by these terms and our Privacy Policy.

1A. Definitions

  • WhoseDev refers to the IDE and AI-assisted development platform, including its desktop application, plugin SDK, backend API, and frontend tools.
  • User means any individual or entity using WhoseDev.
  • Workspace refers to the collection of files, configurations, sessions, or projects created or opened within WhoseDev.
  • Content means any code, file, document, command, or input submitted to or generated from WhoseDev.
  • Third-Party LLMs refers to external large language models such as OpenAI, Claude, DeepSeek, Gemini, and Mistral integrated via WhoseDev's AI system.

2. Eligibility & Accounts

  • You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use WhoseDev.
  • WhoseDev does not knowingly collect or store data from users under the age of 13. If you believe such data has been collected, contact us immediately.
  • You are responsible for securing your account and workspace configurations.
  • AnotiAI may suspend or terminate accounts that violate these terms.

3. License & Acceptable Use

WhoseDev grants you a limited, non-transferable, non-exclusive license to use the platform and tools for development purposes. You agree NOT to:

  • Modify, reverse-engineer, or replicate WhoseDev's core software.
  • Use WhoseDev to deploy or distribute malware, keyloggers, or exploit scripts.
  • Misuse plugin SDKs to break platform policies.
  • Use WhoseDev to violate export control laws, copyright, or data protection regulations.
  • Impersonate other users or perform unauthorized access to projects.
  • Use WhoseDev to train competing LLMs or reverse-engineer model behaviors.
  • Share or expose plugin code that accesses user data without consent.
  • Upload illegal or malicious scripts in shared plugin repositories.

4. Data Handling & Privacy

  • WhoseDev is committed to protecting user data and development workflows.
  • WhoseDev does not store full project contents or session logs unless explicitly enabled by the user.
  • Preferences, themes, Git credentials, or plugin settings are encrypted locally or stored securely in your chosen cloud sync option.
  • WhoseDev never sends full source code to third-party services without your explicit consent.
  • All Git activity is user-controlled. WhoseDev may cache metadata for local search but does not index user repositories externally.
  • When using WhoseDev's AI features powered by multiple LLMs, your prompts are partially masked or anonymized before transmission.
  • API requests to LLMs are routed through WhoseDev's secure backend, ensuring your IP and identifiable data are not exposed to model providers.
  • AI usage logs, if enabled, are encrypted and stored with your explicit consent for session recovery or audit purposes.

5. Intellectual Property

  • WhoseDev and all core services, UI components, branding, and architecture are the property of AnotiAI.
  • You retain full ownership of your code, projects, and workspace content.
  • By using WhoseDev plugin SDKs, you grant AnotiAI permission to distribute your plugin through the WhoseDev ecosystem unless opted out.

6. AI & LLM Output Disclaimer

WhoseDev uses third-party LLMs (e.g., OpenAI, Claude, Gemini) under your explicit control. Outputs may contain biased, hallucinated, or insecure code.

  • Responses may be incomplete, incorrect, or outdated.
  • AI completions are non-binding and require developer verification.
  • All outputs are routed via best-effort masking and privacy enforcement layers.
  • Experimental features (e.g., AI agents, previews, comparisons) are in beta and provided as is.

7. Plugin Use & SDK Distribution

  • Plugin authors are responsible for their plugin's behavior and legal compliance.
  • You must not embed malware, spyware, or unauthorized data collectors.
  • AnotiAI may remove or suspend plugins that violate platform integrity or user safety.

8. Termination

  • Suspend or revoke your access for violation of these terms.
  • Remove unsafe or illegal projects, plugins, or sessions.
  • Disable AI/LLM access for non-compliant usage.

9. Limitation of Liability

WhoseDev is provided as is. AnotiAI is not liable for:

  • Lost work due to system crashes or unsaved sessions.
  • Faulty AI completions, broken plugin execution, or corrupted Git actions.
  • Business, legal, or reputational harm caused by developer use or misuse.

10. Governing Law & Dispute Resolution

This Agreement is governed by the laws of the State of Delaware, USA. Disputes shall be handled via arbitration unless required otherwise by law.

11. Feedback & Improvements

We welcome suggestions. By submitting feedback or bug reports, you grant us the right to incorporate them into the platform without compensation.

12. Updates to These Terms

WhoseDev reserves the right to revise these Terms at any time. If we make significant changes, we will notify users through the platform or via email when appropriate.

14. Copyright Infringement / DMCA Notice

  • Description of the copyrighted work.
  • URL or location of the alleged infringement.

15. Export Control & Compliance

  • Not to access or use WhoseDev in embargoed countries.
  • Not to export or re-export WhoseDev to sanctioned parties.
  • Not to use WhoseDev for prohibited weapons or surveillance applications.
